Gerade die durchaus erfolgreiche Implementierung deutscher Datenschutzprinzipien in die jetzt ma&szlig;gebliche EU-Datenschutzgrundverordnung (EU-DSGVO) k&ouml;nnte ebenfalls zu diesem Schluss verleiten. Und schlie&szlig;lich hat ja auch Baden-W&uuml;rttemberg seit Dezember 2015 &#8222;sein&#8220; Informationsfreiheitsgesetz.<\/p>\n<p>Gerade an der Schwelle zum digitalen Zeitalter machen sich aber auch jene Kr&auml;fte verst&auml;rkt bemerkbar, die dem Anliegen des Datenschutzes schon immer reserviert bis feindselig gegen&uuml;berstanden: Beh&ouml;rden, die Sicherheitsinteressen in den Vordergrund schieben und meinen, es sei &#8222;jetzt nicht die Zeit f&uuml;r Daten- und T&auml;terschutz&#8220;; Gerichte, die ma&szlig;gebliche Normen des Datenschutzrechts ignorieren oder beiseite schieben; sog. Datenschutzexperten, die das Grundrecht schon immer f&uuml;r eine Fehlkonstruktion hielten, und nat&uuml;rlich jene Wirtschaftskr&auml;fte, die das &#8222;Grundrecht auf &ouml;konomische Verwertung der pers&ouml;nlichen Daten anderer&#8220; f&uuml;r vorzugsw&uuml;rdig halten. Und auch dem zarten Pfl&auml;nzchen Informationsfreiheit ist vielf&auml;ltige Gegnerschaft gewiss. Die soeben vor sich gehende Novellierung des Bundesdatenschutzgesetzes ist ein betr&uuml;bliches Beispiel.<\/p>\n<p>Gr&uuml;nde genug und Zeit f&uuml;r eine n&uuml;chterne, aber wohl nicht hoffnungsfreie Bestandsaufnahme, die der oberste Datensch&uuml;tzer des Landes im Rahmen Vortragsreihe TACHELES vornehmen wird&nbsp; &#8211; wie schon vor ihm&nbsp;seine Vorg&auml;nger im Amt J&ouml;rg Klingbeil im Jahre 2013 und Peter Zimmermann im Jahre 2008.<\/p>\n<p>Zur Person: Seit dem 1. Januar 2017 ist Dr. Stefan Brink Landesbeauftragter f&uuml;r den Datenschutz und die Informationsfreiheit in Baden-W&uuml;rttemberg. Er wurde vom Landtag Baden-W&uuml;rttemberg f&uuml;r die Dauer von sechs Jahren gew&auml;hlt. Von 2008 bis 2016 war er Leiter Privater Datenschutz beim Landesbeauftragten f&uuml;r den Datenschutz Rheinland-Pfalz, seit 2012 zugleich Stellvertretender Landesbeauftragter f&uuml;r die Informationsfreiheit Rheinland-Pfalz.<\/p>\n<p><i>Eine Veranstaltung im Rahmen der Vortragsreihe TACHELES &#8211; organisiert von der Humanistischen Union Baden-W&uuml;rttemberg, dem Institut f&uuml;r Kriminologie und Wirtschaftsstrafrecht (Freiburg), in Kooperation mit dem Arbeitskreis kritischer Juristinnen und Juristen (Freiburg).<\/i> Die Teilnahme an der Veranstaltung ist wie immer kostenfrei.
